Unless an employer has “cause” for firing an employee, employees have the right to notice of termination. Determining whether a particular termination was actually “wrongful” (entitling an employee to severance) can be a complicated issue. Sometimes an employer may think that they have a good enough reason to let someone go without notice, but legally they may be wrong (and on the hook for potentially tens of thousands of dollars). Other times, an employment contract may clearly say that an employee only gets a few weeks of notice, but legally this contract may not be enforceable.
